For this reason many consumers may feel discouraged and may not know what to do in order to be able to meet their monthly debt obligations.
Debt Counselling, also known as Debt Review, is a formal legal process in which an over-indebted consumer has the opportunity to formally restructure his/her debt, in order to pay outstanding debts in a structured manner.
A over-indebted consumer who do not adhere to the monthly payment obligations towards credit providers, run the risk to have legal action instituted against them, and as such have their assets attached by the Sheriff, whereafter it will be sold in execution in order to pay outstanding debts.
The Debt Counsellor will assess the consumer’s financial situation to determine if the consumer is over-indebted and negotiate a reduced monthly amount with the consumer’s credit providers. This will ensure that the consumer will be able to act pro-actively and avoid legal action being instituted for not adhering of the credit agreement.
Once the debt of the consumer is settled, the Debt Counsellor will issue the consumer with a clearance certificate, whereafter the consumer is released from Debt Review.
